False accusation of hit and run (RI)?

I have been accused by the State Police of Rhode Island of having been involved in a hit and run accident. I have already been to the state police barracks and given a statement.


They also took photographs of the car and myself, and then showed those pictures to who ever is making this claim against me. They have confirmed that it was me and the car, but i wasnt in any accident.


It has been alleged that I was in this accident around 6:00pm on the day of the accident. At this time i was at my girlfriends work and another one of her co workers can confirm this.


This morning the state police arrived at my house and arrested me on counts of hit and run and obstruction of justice. I was held in a jail cell for about 5 hours and then released on 100 dollars bail. I have a court arraignment in 3 days.

That's terrible! Get a lawyer asap, and get a statement from both your g/f and the co-worker. Maybe go back to the police dept and offer to take a lie detector test. Does your g/f place of employment have video cameras? That would be golden!! Good luck!False accusation of hit and run (RI)?
Bring your witnesses with you to court. I would also try and get a lawyer. After you win the case or it is dismissed....sue the person that said you hit them and the state police for false imprisonment...any good lawyer will jump at a case like yours...good luck and be strong
First of all get an attorney.


Then get your alibis and if possible bring them to court or talk to your attorney.





If you did not do it, you should be able to walk away from this.


Then sue the guy who blamed you for the hit and run.

It is called due process.





A lawyer to represent you is strongly recommended, since you are unclear on even the basic concept.
What do you do? You hire a lawyer before the arraignment. if you can not afford one, you contact the public defenders office and request one. Don't go it alone, this is not just a traffic ticket, you could do time.
Get a lawyer and have your girlfriends co-workers and boss testify. Then...If your want your 100 dollars back sue the person the accused you.
You really need to get a lawyer. Why haven't you gotten one? You should have had one way before they put you through all this crap. Also, I agree with the other guy. Get some witness to confirm your timing and location.





Next you can sue for slandering and false imprisonment. Besides, shouldn't there be damage on your car if you hit someone. Blood and dents, etc. Must be some jerk who's trying to ruin your reputation. Didn't the police tell you your rights when you got arrested?





It's against the law if they didn't. Also, they should have told you had the right to get an attorney. If this gets worse, they will either provide one for you, or you get your own. I suggest you get your own. A really good one and then sue the bastard who's falsely accusing you so they can pay for your pain, suffering, and lawyers' fees. It's gonna be a lot.

You'll get arraigned wherby they will charge you with Hit and Run. You will get the opportunity to get a court appointed lawyer if you qualify. The judge will explain what the big picture looks like, a right to a trial by a jury of your peers, etc. You plead guilty or not guilty. They will set up a pretrail in about 6 weeks. At that time you will have met with a lawyer to explain what you know, what they say happened, etc. Tell your lawyer you want to see the police report if you haven't gotten one already. You put a request into the prosecutor for what ever info you need: med bills, the witnesses who saw you, the damage, etc. They can ask you for the same. Take pics of your car, have your witnesses be prepared. You basically have to prove your self innocent. Check out findlaw.com and look through out the site for any info that you may need.
