Making a false accusation to the police?

If you make a false accusation to the police, what are the consequences? Is it a arrestible offence?Making a false accusation to the police?
Making a false complaint can be either ';wasting Police time'; or the much more serious offence of ';perverting the course of justice.'; In the brief circumstances you give I would suggest both are committed but that the later offence is more applicable because that applies where someone does an act tending to pervert the course of justice, which includes doing an act which could result in the prosecution of someone for an offence they have not committed. Any offence is arrestable nowadays so long as certain criteria are met, so that is not an issue.





The Police arrested you because they had an allegation of an assault. The Police take allegatons in many forms, either a verbal or written allegation is sufficient for them to take initial action. For the matter to go to Court written or video evidence is required from the person making the allegation.





Once the Police investigate and discover it to be malicious then the investigation should turn to the person who made the false allegation. I would suggest speaking to a solicitor, getting him or her to make a formal written allegation to the Police and then justice will take its course.





You need to ensure the CCTV is persevered and that your solicitor mentions this evidence and the need for its early seizure and retention or you will lose your main evidence. This is a job for the Police but if they are busy then they may need to solicitors letter to prompt them, alternatively if the CCTV is with your employer you could contact them and ensure they retain it until the Police collect it.Making a false accusation to the police?
no its your word against hers ,without any wounds she can only take you to court for common assault ,which she would lose cos u got witnesses .She should be done for false allegation and wasting police time
Not only is it an arrestable offence, it is a CRIMINAL offence.

Yes it is. If you have done this, go back to the station and tell them. Scary thought maybe, but they will be more tolerant the sooner you confess.
I experienced this. I learnt that even while you try to get the true facts in place, the facts may be obscure to you as well as the police. So you both have differing facts and whom is saying the truth is actually unknown, they are both theories of a situation. All you can do is tell your true version of the facts and let the course takes it's path. It is the collecting of these true facts that the police can sort through it all and conclude the best theory. No 2 witnesses will tell the exact story to an event. When they do you need to double check the facts. The police cannot tell whom is lying as much as whom is not telling the truth, like missing facts.Not so much a lie as it is more of a deception. That is when they take statements they can sort thru those statements, but sometimes many statements are missing.


So yes you can by decieving an officer by lying or deceptive practices. You can get arrested for obstruction of justice. If there was an investigation , and found you a liar. Like accusing someone of something they never did, you can also get sued.
False accusations carry little to any punishment. Usually at most a slap on the hand.





That is why false allegations of abuse and rape are quite common. There is just no real consequence for it.





For example, I am sure that the girl that falsely accused the Duke players for rape, is walking around happy as a lark.





The evil ones who use false allegations of child abuse in custody fights, etc. are never punished, etc.

It can result in a custodial sentence. I don't think some people have read your question properly. It would seem that you didn't make the false accusation but you have been arrested for assault. It is one person's word against another unless there is physical evidence that you did assault this person.

It would appear that you live in UK as you mention a job centre.The consequences depend on the result for instance if you cause a large amount of police time to be used on the false allegation this is wasting police time but is rarely prosecuted as it requires a large amount of evidence gathering and cost to the public.An arrestable offence is defined in UK law and is what used to be called a felony years ago I think you mean can someone be arrested which is different in that case yes you can be arrested for doing this.
In Canada making the police conduct a false investigation is a crime called ';public mischief.'; I dont know about the states, but I'd imagine that there is something similar. If you have witnesses, then use them to file a charge against her for the equivalent offence to public mischief.
Yes, it is illegal. In Illinois, filing a false police report is actually a felony.
yes it is called perverting the course of justice and could mean a custodial sentence if it was deemed serious enough.If it was not it could mean a caution but whatever happens you should not do it it really is not nice making false accusations is it?
Yes it is. go back to the police and apologise for being stupid and you will probably get only a slapped wrist. if you don't own up you are only getting into more trouble
You could be charged with wasting police time. Don't think they would arrest you though.
