How would people on here suggest false rape accusations be proven?

I'm all in favor of pressing charges if it's proven, but how to do this?How would people on here suggest false rape accusations be proven?
are false allegations now more important than rape itself?


this is a sad reflection of humanity.





the vast majority of rape charges are not false and in fact are not prosecuted.





only 13% of rape charges end in conviction in the usa.


only 5.7% end in conviction in the uk.





the vast majority of raped people do not even press charges.





how can we get victims to press charges - why is it you guys never ask that? you only worry about so-called ';innocent men.'; even the innocence project does not list false allegations as a factor for innocent men being in jail.





shame on you. are you not even human?





what are you doing for men in jail? what have you done for black men?

I know some victims refuse to have a rape kit down because it's humiliating and they're adamant about not wanting to press charges. Rest assured, someone who makes false allegations will refuse a rape kit. I wish people wouldn't make allegations unless they were true because it makes it harder for the real victims to come forward because they're less likely to believe the police will believe them. If someone comes forward with false allegations and refuses to have the rape kit done I guess the only way to find out the allegations are false is to dig into the alleged victim's past. Police don't want to waste precious time investigating false charges because that is time that could have been spent on real cases. At the very least it ticks them off.
I think the DA's main focus for a case being built against any person's who's falsified rape charges; after the ';not guilty'; verdict has been given is to take the false victim back to court under charges of perjury (Making false claims and lying under oath). This was one of the nails in the coffin for the female rapper ';Lil' Kim'; court case that landed her I think 3 years in prison. I'm sure there are a number of other charges that can be brought against someone who's charged false allegations of rape in court. For example slander or defamation of character (ruining the supposed perpetrators good name) which can and does cause the assumed rapist to loser their job (wages lost), lose a license to practice his or her profession, maybe even court fees paid for a divorce if he/she is married. Now, once its been proven that the woman or man was not guilty of rape, they will not be listed as a registered sex offender, they will not spend any more time in jail (only time served) and they will have their criminal record reflect them being exonerated of all or most of the charges against them. Remember, there may be a number of charges pending against the assumed rapist (i.e. assault and battery, maybe stalking and kidnapping, if underage drinking is involved, providing alcohol to a minor). So he/she may not be cleared of all the charges being brought against them, but if its proven that they're not guilty of rape they will be relased and cleared of that specific charge.





In my own opinion, I think anyone who fasly accuses someone of rape, they should receive the same prision sentance that the assusmed perpertator would have received had they'd been found guilty. I think that he/she should recieve the title of 'sex offender' and be added to the national database, so that they may see what a fasly accused sex offender would have to go through had they been found guilty.
It has been proven many times that these allegatation are no higher then false reporting of any other crime. Please see US Justice or Government of Canada for statistical proof.


I agree that if anyone accuses another and it is proved unfounded then consequences should arise. As one poster stated it is known as perjury or at the least public mishief.


The majority of rape cases do go unpunished as many are afraid to follow through with a justice system that tends to retraumatize the victims by the process which they must go through.
Simply because there is a not guilty does not mean someone is innocent or the charges are false.

Secondly a tape means nothing - courts have ruled you can say no during sex. The male must stop.
I've never heard of a someone getting into trouble for this. Or a woman for making up restraining orders. And bad women know this and use it all the time. Women should be as outraged as anyone.
It's called perjury. It's already a crime.
Perhaps the same way (only opposite) that rape is proven.
If he can provide a tape recording of her agreeing to having sex or a video tape of the encounter and then shows that in court then I'd say she deserves to get burned really badly for false rape. Why do you think so many men want to video tape sex today? We can get porn for free off the net. The tapes are for our defense against sick minded women like that.
There in lies the problem .
